Original Penguin’s parent company filed a lawsuit against Pudgy Penguins in the Southern District of Florida. The suit claims Pudgy Penguins used penguin-related marks without authorization. The complaint alleges the crypto brand infringed on Original Penguin’s long-standing trademarks.
PEI Licensing, which manages Original Penguin, said Pudgy Penguins’ designs and word marks create market confusion. The company highlighted similarities in apparel and headwear products. The lawsuit seeks to prevent further use of these marks in commerce.
The filing also requests monetary compensation for Pudgy Penguins’ sales profits. PEI wants any existing products with similar marks destroyed. It demands that the USPTO reject Pudgy Penguins’ pending trademark applications.
The suit emphasizes that Pudgy Penguins’ conduct violates fair competition laws. PEI argued the crypto brand’s actions damage its goodwill and reputation. The company cited examples of overlapping penguin designs in clothing products.
PEI noted that Pudgy Penguins applied for trademarks including phrases like “Pengu Nation.” These applications involve goods that PEI already covers with its marks. The firm argued that such registrations threaten consumer clarity and brand distinction.
The lawsuit states Pudgy Penguins continued use of these marks despite previous warnings. PEI sent a cease-and-desist letter in October 2023. The company also filed opposition notices with the USPTO in 2024.
Pudgy Penguins said it was surprised by the legal action. The company claimed ongoing private discussions had aimed to resolve conflicts. It maintained that its trademarks are visually distinct from Original Penguin’s marks.
The crypto brand highlighted that it already secured multiple USPTO approvals for its marks. Pudgy Penguins insisted it targets different markets and audiences than Original Penguin. The company remains confident the court will reject PEI’s claims.
The lawsuit also seeks to stop Pudgy Penguins from further using penguin-related designs. PEI wants all products potentially causing confusion removed from the market. The firm continues to monitor the brand’s merchandising and online sales activities.
Pudgy Penguins launched its Ethereum NFT collection in 2021 and became a significant crypto brand. It developed a Solana-based culture coin, PENGU, and sold physical toys in major retailers. The collection reportedly generated over $10 million in sales within its first year.
The case underscores ongoing conflicts between traditional trademarks and NFT-related brands. PEI Licensing asserts its rights date back to 1956 for the penguin design. The legal outcome could set precedents for IP enforcement against emerging crypto companies.
