[EDITORIAL] Kapag na-weaponize ang anti-money laundering laws

Nitong nakalipas na linggo, nahatulan si community journalist Frenchie Mae Cumpio at human rights worker Marielle Domequil ng terror financing.

Terror financing? Ano ‘yan? May nagaganap bang pagkilos ng mga terorista na dapat nating ikabahala? Tila wala sa kaso nina Cumpio.

Na-convict ang dalawa hindi dahil sa money trail, kundi dahil sa pagtestigo ng “rebel returnees” na nasa bundok daw ng Catbalogan ang dalawa at nag-abot ng P100,000 cash para sa New People’s Army. Pero ayon kina Cumpio, ang pondo ay para sa komunidad na na-displace ng militarisasyon sa Leyte at Samar.

Dahil diyan, nakulong ng anim na taon ang dalawang kabataan, at mukhang magtatagal pa sa kulungan dahil ang sentensiya sa kanila ay malupit na 8-12 taon.

Pero hindi ito simpleng miscarriage ng justice. Nakakabit ang lahat ng ito sa “gray list” ng Financial Action Task Force na inisyatibo ng G7 countries.

Kapag nasa gray list ang isang bansa, ibig sabihin palyado itong pigilan ang pagpasok ng dirty money o terror money. Notoryus ang Pilipinas diyan — andiyan ang napakaraming POGOs na daluyan ng syndicate money, at money laundering tulad ng kaso ng 2016 Bangladesh Bank cyber heist at German payment processor Wirecard.

May kaakibat itong bigwas sa pananalapi ng Pilipinas dahil bumababa ang financial reputation at puwedeng maapektuhan ang credit rating ng bansa.

Pero ayon sa Human Rights Watch, ang ginamit na solusyon — dahil hirap sa paghuli ng mga sindikato at gigil talaga sa Kaliwa — ay ang paghahain ng maraming terror financing cases laban sa mga progresibong organisasyon.

Para sa Committee to Protect Journalists, ipinapakita ng ruling ang “pagpupursige ng militar at gobyerno na patahimikin ang mapanuring mapamamahayag.”

Pangit na mukha ng batas at sistema ng hustisya ang ipinamalas ng Cumpio conviction. Hatinggabi siya inaresto, isang classic harassment ng mga otoridad. Inabot ng limang taon bago nakapag-testify si Cumpio. 

Binaluktot ang isang batas sa pananalapi at ginamit laban sa mga aktibista, habang ang mga tunay na sindikato at money launderers ay hindi pa nahuhuli tulad ni Pharmally boss Lin Weixiong. At lalayo pa ba tayo? Ang mga mastermind ng pagnanakaw ng bilyones sa flood control projects, laya pa at malamang ine-enjoy ang male-maleta nilang cash. Pero nag-mobilize ang pamahalaan laban sa mga aktibista at P100,000 nilang cash.

Sa bandang huli, ang batas na naglalayong pigilan ang money laundering ay na-weaponize at ginagamit upang busalan ang mga kritiko. 

Masalimuot ang kuwentong tumatawid mula sa mundo ng international financing papuntang 56-year-old insurgency. Tulad ng dati, ang bulnerable ay ang mga kumikilos sa cause-oriented groups na easy game sa militar at draconian na anti-terror law. 

Pero napakalaki ng kapalit sa nawalang taon sa buhay ng mga aktibistang nakulong na nang matagal, at ngayon ay na-convict. – Rappler.com
