PANews reported on March 20th that, according to CoinDesk, the U.S. Ninth Circuit Court of Appeals rejected Kalshi's request, clearing the way for Nevada to issue a temporary restraining order against the prediction market platform. This means that Nevada can immediately apply to its state court for an injunction, forcing Kalshi to suspend operations locally for at least two weeks.
In March 2025, the Nevada Gaming Control Board issued a cease and desist order to Kalshi, requiring it to cease offering contracts for sports-related prediction markets. Kalshi's previous attempt to transfer the case to federal court was unsuccessful, and the case will now be returned to state court. Kalshi had previously warned that if the appeals court did not grant its request, the company would face "imminent harm," potentially requiring litigation in four different courts on the same jurisdictional issue, and risking conflicting rulings from federal and state courts.
