Alan Dershowitz predicts Supreme Court will go against Trump

Harvard Law Professor Alan Dershowitz predicted the Supreme Court will likely reject President Donald Trump's effort to end birthright citizenship following Wednesday's oral arguments.

Dershowitz stated that while Trump's administration seeks an absolute rule against citizenship based on birth in the U.S., "The [14th] amendment itself gives to Congress the right to implement this amendment, and it can do it in a way that makes sense."

Dershowitz suggested the justices could issue an intermediate decision acknowledging congressional power to define jurisdiction without fully accepting Trump's position.

He noted the high court could also rule outright against the administration's view.

Dershowitz emphasized that oral argument trends suggest the justices are moving away from Trump's position, cautioning that predictions based on oral arguments remain uncertain.

He concluded, "You never can predict how the court's going to come out based on oral argument, but the oral argument is trending away from the president."
