US Midterm Elections 2026: What the Results Could Mean for Crypto and Bitcoin

Key Takeaways

Americans vote on November 3, 2026 for all 435 House seats and about one-third of the Senate, with control of both chambers at stake.
The crypto industry spent about $170 million to $176 million on the midterms, led by the Fairshake super PAC, making it one of the largest corporate spenders of the cycle.
The CLARITY Act, the main crypto market structure bill, stalled in 2026. Its future depends heavily on who controls Congress in 2027.
Prediction market Kalshi gave Democrats about a 70% chance of winning both chambers as of November 1, according to CoinDesk.
For Bitcoin, which trades near $78,000, the election is one of several catalysts this week, alongside Friday's jobs report and the Binance hack recovery.
Election Day in the United States has arrived, and crypto has more riding on the outcome than ever before. The industry has poured well over $170 million into congressional races, and a key market structure bill is stuck in the Senate.
The results will decide which party controls the House and Senate for the next two years, and with it, which crypto bills move forward, who leads key committees and how regulators are overseen. Here is what is at stake for crypto in the 2026 midterms, the races to watch and what the results could mean for the Bitcoin price.

What Is at Stake for Crypto in the 2026 Midterms?

Control of Congress

All 435 House seats and about one-third of the Senate are on the ballot. Republicans currently hold narrow majorities in both chambers. Reuters has described Democrats as favored to win the House, with the Senate more competitive, while Kalshi's prediction market put the odds of Democrats winning both chambers at about 70% as of November 1, according to CoinDesk. Prediction market odds can change quickly and are not a forecast of the final result.

The CLARITY Act

The Digital Asset Market Clarity Act, known as the CLARITY Act, is the industry's top legislative goal. It would set rules for crypto markets and shift much of the oversight to the Commodity Futures Trading Commission (CFTC). A Senate cloture vote on the bill failed in September 2026, and it did not advance this year.
Reuters reported that the Senate impasse centered in part on an ethics provision that would have required the Trump family to sell its crypto holdings. Supporters argue the bill would give the industry clear rules of the road. Critics, such as Gary Kalman of Transparency International, say it would move oversight to a less stringent regulator and preempt tougher state laws. Any future version will still need 60 votes in the Senate, which means support from both parties.

Stablecoin Rules and Crypto Taxes

The GENIUS Act, passed in 2025 with bipartisan support, created the first federal stablecoin framework, and regulators face a rulemaking deadline of January 18, 2027. On taxes, the Digital Asset Tax Certainty Act passed the House Ways and Means Committee in September, though some Democrats, including Rep. Don Beyer, voted against it, citing concerns about fraud and illicit finance.

Retiring Crypto Champions

More than 80 members of Congress are retiring, including Sen. Cynthia Lummis and Sen. Thom Tillis, both key Republican negotiators on crypto bills, so the industry will need new advocates whichever party wins.

How Much Has the Crypto Industry Spent on the Midterms?

Crypto has become one of the biggest political spenders in the United States. Reuters reported that the industry spent about $176 million across more than 100 races, while CoinDesk counted about $170 million from the three leading crypto super PACs. Public Citizen said crypto was the single biggest corporate spender in federal races in 2026.

Fairshake says 53 of the 58 candidates it backed in primaries or special elections this year won. It supports candidates from both parties in House races, but only Republicans in Senate races after Senate Democrats blocked the CLARITY Act from a final vote. Supporters of the spending, such as the Solana Policy Institute's Colin McLaren, call it "an investment in the future." Critics see it differently. Sen. Cory Booker has questioned the PACs' claims of bipartisanship, and some candidates targeted by the ads said the spending made it hard for others to compete.

Key Races to Watch

Ohio Senate: The most expensive race for crypto. Fairshake committed about $56 million to defeat Democrat Sherrod Brown, a longtime crypto critic, who faces Republican Jon Husted. Industry spending on the race topped $68 million, according to AdImpact data cited by Reuters, and public polls showed Brown with a narrow lead.
Nebraska Senate: Fairshake committed nearly $11 million to support Republican incumbent Pete Ricketts.
Texas Senate: The Digital Freedom Fund spent against Democrat James Talarico, who faces Republican Ken Paxton.
Iowa: The Digital Freedom Fund spent heavily against Democrat Josh Turek in his race against Republican Ashley Hinson.

What the Midterm Results Could Mean for Crypto

Scenario 1: Divided Government

If one party wins the House and the other keeps the Senate, major crypto legislation would likely need broad compromise. Bills like the CLARITY Act could stall further, while regulators continue to shape the industry through rules and guidance.

Scenario 2: Democrats Win Both Chambers

Democrats would set the legislative agenda and lead committees from January 2027. Forbes reported that key Democrats plan Oversight Committee hearings on crypto in 2027, which could bring more scrutiny of the industry. Reuters noted that the CLARITY Act faces an uphill battle if Democrats win a chamber, and JPMorgan analysts have warned that agency rules made in the current administration could be reversed later without a law in place.

Scenario 3: Republicans Keep Both Chambers

Republicans would keep control of committees and could try again to pass market structure legislation. However, they would still need Democratic votes to reach 60 in the Senate, so the ethics and oversight disputes that stalled the bill this year would remain.

How Could the Midterms Affect the Bitcoin Price?

In the short term, the election may matter less for Bitcoin than the overall direction of rates and risk sentiment. Bitcoin trades near $78,000 after falling about 7% in October, and markets price about an 85% chance of a Federal Reserve rate hike in December.
Historically, crypto markets have often been volatile ahead of midterms, but price moves afterward have been driven mostly by other factors. After the 2022 midterms, for example, the collapse of the FTX exchange had a much larger impact on prices than the election itself.
What to watch around the results:
Overnight volatility: Polls close in the evening US time on November 3, so most results will arrive during Asian and European hours on November 4. Crypto trades 24/7 and will react before Wall Street opens.
Policy signals: Comments from party leaders about crypto legislation in 2027 could move sentiment.
Other catalysts: The October jobs report on November 6 and the Binance hack recovery could matter just as much this week.
Key Bitcoin levels to watch are support at $76,000 and resistance at $80,000.
