การใช้วิธีการอัตโนมัติและ/หรือการตั้งโปรแกรมโดยไม่ได้รับอนุญาต รวมถึงแต่ไม่จำกัดเพียงเครื่องมือ สคริปต์ การเชื่อมโยงโดยตรง บอท และสไปเดอร์ เพื่อวางคำสั่งหรือดำเนินการคำสั่ง</div><div style="text-align:left;text-indent:2em">5.2.2 การใช้อุปกรณ์ เครือข่าย หรือที่อยู่ IP ที่ผิดปกติ หรือวิธีการอื่นใด ไม่ว่าจะเป็นทางเทคนิคหรือไม่ก็ตาม เพื่อปกปิดตัวตนหรือกิจกรรมการเทรด</div><div style="text-align:left;text-indent:2em">5.2.3 การสแกนหรือตรวจสอบ API ที่ไม่ได้ระบุไว้ หรือพยายามค้นหาเอนด์พอยต์ที่ซ่อนอยู่</div><div style="text-align:left;text-indent:2em">5.2.4 การใช้ลำดับโปรโตคอลที่ไม่เป็นไปตามมาตรฐาน หรือพยายามหลีกเลี่ยงการตรวจจับด้วยวิธีอื่นใด</div><div style="text-align:left;text-indent:2em">5.2.5 การแอบอ้างเป็นลูกค้าหลายราย การปลอมแปลงรหัสอุปกรณ์ ตัวแทนผู้ใช้ หรือตัวระบุเซสชัน</div><div style="text-align:left;text-indent:2em">5.2.6 การส่งและยกเลิกคำสั่งจำนวนมากเพื่อบิดเบือนสมุดคำสั่ง (การปลอมแปลงคำสั่ง การยัดเยียดใบเสนอราคา การโจมตีด้วยคำสั่งจำนวนมาก)</div><div style="text-align:left;text-indent:2em">5.2.7 การใช้พร็อกซี/VPN/เครือข่ายแบบกระจายอย่างเป็นระบบเพื่อปกปิดตัวตนหรือแบ่งขีดจำกัด</div><h2 การเทรดด้วยตนเอง การเทรดล่วงหน้า การปั่นราคา การหลอกลวงหรือการวางซ้อน การทำธุรกรรมที่ประสานงานกันระหว่างบัญชีที่เกี่ยวข้องหรือในเครือเดียวกัน</div><div style="text-align:left;text-indent:2em">5.3.2 การกระทำโดยเจตนา เช่น การใช้ประโยชน์จากข้อได้เปรียบด้านเงินทุนหรือสภาพคล่อง เพื่อทำให้ราคาของสินทรัพย์ดิจิทัลใดๆ สูงขึ้นหรือต่ำลงอย่างผิดปกติ หรือเพื่อบิดเบือนราคาในลักษณะอื่นๆ</div><h2 style="text-align:left"><strong style="font-weight:bolder">5.4 การเทรดหลักทรัพย์โดยใช้ข้อมูลภายใน หรือการเทรดตัดหน้าลูกค้า</strong></h2><div style="text-align:left;text-indent:2em">กิจกรรมใดๆ ที่เกี่ยวข้องกับการใช้ข้อมูลสำคัญที่ไม่เปิดเผยต่อสาธารณะ หรือการดำเนินการตามคำแนะนำ ข้อมูลที่รั่วไหล หรือคำสั่งจากบุคคลที่มีสิทธิ์เข้าถึงข้อมูลแพลตฟอร์มล่วงหน้าหรือมีสิทธิ์พิเศษ รวมถึงแต่ไม่จำกัดเพียง:</div><div style="text-align:left;text-indent:2em">5.4.1 การประสานงานการเทรดกับบุคคลภายใน พนักงาน บริษัทในเครือ หรือบุคคลที่มีความรู้ขั้นสูงเกี่ยวกับเหตุการณ์การเทรดหรือการจดทะเบียนในตลาดหลักทรัพย์</div><div style="text-align:left;text-indent:2em">5.4.2 การดำเนินการเทรดล่วงหน้าก่อนที่ลูกค้ารายใหญ่หรือแพลตฟอร์มจะสั่งซื้อ (“การเทรดตัดหน้าลูกค้า”)</div><div style="text-align:left;text-indent:2em">5.4.3 การใช้ข้อมูลที่เป็นความลับหรือข้อมูลที่รั่วไหลซึ่งได้มาจากพนักงาน คู่ค้า หรือผู้จำหน่าย เพื่อให้ได้เปรียบทางการค้าอย่างไม่เป็นธรรม</div><h2 style="text-align:left"><strong style="font-weight:bolder">5.5 การหลบหลีกขีดจำกัดโพสิชัน</strong></h2><div style="text-align:left;text-indent:2em">กิจกรรมใดๆ ที่แบ่งหรือกระจายโพสิชันการลงทุนไปยังบัญชีหลายบัญชี บัญชีย่อย หรือตัวกลางบุคคลที่สาม เพื่อรวมความเสี่ยงให้เกินกว่าขีดจำกัดโพสิชันการลงทุนของผู้ใช้รายเดียวของแพลตฟอร์ม ซึ่งรวมถึงแต่ไม่จำกัดเพียง:</div><div style="text-align:left;text-indent:2em">5.5.1 การเทรดแบบประสานงานระหว่างบัญชีที่เกี่ยวข้องหรือบัญชีในเครือ เพื่อหลีกเลี่ยงข้อจำกัดด้านมาร์จิ้น เลเวอเรจ หรือโพสิชันการเทรด</div><div style="text-align:left;text-indent:2em">5.5.2 เพื่อหลีกเลี่ยงการควบคุมการเทรดหรือการควบคุมสถานะการลงทุน</div><h2 style="text-align:left"><strong style="font-weight:bolder">5.6 การใช้กฎในทางที่ผิดและการแสวงหาผลประโยชน์โดยมิชอบ</strong></h2><div style="text-align:left">การกระทำใดๆ ที่มุ่งหมายจะใช้ประโยชน์จากข้อตกลงผู้ใช้ กฎ ระบบ หรือนโยบายของ MEXC เพื่อผลประโยชน์ที่ไม่ชอบธรรม ซึ่งรวมถึงแต่ไม่จำกัดเพียง:</div><div><div>5.6.1 การใช้หลายบัญชี บัญชีย่อย หรือบัญชีของบุคคลที่สาม เพื่อหลีกเลี่ยงกฎ ข้อกำหนด คำสั่ง ข้อจำกัด ขีดจำกัดสถานะ หรือมาตรการควบคุมความเสี่ยงที่บังคับใช้ รวมถึงเพื่อวัตถุประสงค์ในการทำอาร์บิทราจที่ไม่เหมาะสม หรือเพื่อให้ได้มาซึ่งการเปิดรับความเสี่ยงโดยรวมเกินกว่าระดับที่อนุญาต</div><div>5.6.2 พฤติกรรมการเทรดที่มีการประสานงานหรือมีโครงสร้างระหว่างหลายบัญชี โดยมีเจตนาเพื่อสร้างอิทธิพลต่อกลไกตลาดอย่างไม่สมส่วน หรือเพื่อบิดเบือนราคา ความลึกของตลาด หรือสภาพคล่องของตลาด รวมถึงรูปแบบที่มีการส่งคำสั่งและยกเลิกคำสั่งบ่อยครั้ง การดำเนินธุรกรรมพร้อมกัน หรือการเทรดระยะสั้นซ้ำ ๆ ที่ทำให้กิจกรรมตลาดตามปกติบิดเบือน</div><div>5.6.3 การทำเฮดจิ้ง อาร์บิทราจข้ามตลาด หรือกลยุทธ์การซื้อขายอื่นใดที่ใช้ประโยชน์จากความแตกต่างของกฎ ช่องโหว่ของระบบ ช่องว่างด้านราคา ความแตกต่างของเวลาแฝง (latency) หรือสภาวะสภาพคล่องที่ผิดปกติ เพื่อดำเนินการอาร์บิทราจแบบไร้ความเสี่ยงหรือเกือบไร้ความเสี่ยง ซึ่งรวมถึงแต่ไม่จำกัดเพียง</div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>การเทรดที่กระจุกตัวในช่วงช่องว่างราคาที่สามารถคาดการณ์ได้ (รวมถึงแต่ไม่จำกัดเพียงช่วงเปิด/ปิดตลาด หรือการเปลี่ยนช่วงการซื้อขาย) เหตุการณ์ข่าว หรือช่วงที่มีสภาพคล่องต่ำ</div></li><li style="text-align:left"><div>การถือโพสิชัน long และ short พร้อมกัน ซึ่งก่อให้เกิดการล็อกหรือการเฮดจ์ความเสี่ยงโดยไม่มีความเสี่ยงของตลาดที่แท้จริง</div></li><li style="text-align:left"><div>การใช้ข้อได้เปรียบทางเทคนิค เครือข่าย หรือโครงสร้างพื้นฐาน เพื่อให้ได้การดำเนินธุรกรรมภายใต้สภาวะตลาดที่ไม่เป็นมาตรฐาน</div></li></ul><div>กิจกรรมดังกล่าวอาจถูกตรวจสอบหรือถูกจำกัด หากเกี่ยวข้องกับเงินที่ได้มาโดยมิชอบ การใช้ประโยชน์จากกลไกของแพลตฟอร์มในทางที่ไม่เหมาะสม หรือการรบกวนสภาพแวดล้อมการซื้อขายที่เป็นธรรมและเป็นระเบียบ</div></div><h2 style="text-align:left"><strong style="font-weight:bolder">5.7 กิจกรรมฉ้อโกงที่เกี่ยวข้องกับการฝากและถอนเงินเฟียต OTC ที่ผิดปกติ</strong></h2><div style="text-align:left">หมายถึงกิจกรรมที่ต้องสงสัยว่าเป็นการฉ้อโกงหรือผิดกฎหมายที่เกี่ยวข้องกับเงินทุน ซึ่งดำเนินการโดยผู้ใช้ในระหว่างการฝากหรือถอนเงินเฟียตแบบ OTC รวมถึงแต่ไม่จำกัดเพียง:</div><div style="text-align:left">5.7.1 การใช้บัญชีธนาคาร เครื่องมือการชำระเงิน วอลเล็ตอิเล็กทรอนิกส์ หรือข้อมูลระบุตัวตนที่ถูกขโมย ปลอมแปลง ไม่ได้รับอนุญาต หรือผิดปกติ เพื่อทำการธุรกรรม</div><div style="text-align:left">5.7.2 การมีส่วนร่วม การช่วยเหลือ หรือการใช้ช่องทาง OTC เพื่อกระทำการฉ้อโกงทางโทรคมนาคม การรับโอนเงินผิดกฎหมาย การหลอกลวงทางสังคม โครงการระดมทุนที่ผิดกฎหมาย หรือการชักชวนให้ประชาชนฝากเงินโดยไม่ชอบด้วยกฎหมาย และกิจกรรมทางอาญาหรือกิจกรรมต้องห้ามอื่นๆ</div><div style="text-align:left">5.7.3 การทำธุรกรรมด้วยเงินทุนที่มีแหล่งที่มาหรือวัตถุประสงค์การใช้งานที่ผิดปกติ หรือไม่สอดคล้องกับข้อมูลส่วนตัวของผู้ใช้ โปรไฟล์ความเสี่ยง วัตถุประสงค์ที่แจ้งไว้ หรือพฤติกรรมการทำธุรกรรม</div><div style="text-align:left">5.7.4 การมีส่วนร่วมในรูปแบบการเคลื่อนไหวของเงินทุนที่ผิดปกติ ซึ่งรวมถึงแต่ไม่จำกัดเพียง การไหลเข้า/ไหลออกของเงินทุนอย่างรวดเร็ว การทำธุรกรรมมูลค่าสูงหรือความถี่สูงโดยไม่มีวัตถุประสงค์ทางเศรษฐกิจที่ถูกต้อง การจับคู่คู่สัญญาที่ไม่ตรงกันหรือผิดปกติ หรือการไหลเวียนของเงินทุนที่ไม่โปร่งใส</div><div style="text-align:left">5.7.5 พฤติกรรมอื่นใดที่ขัดขวางการบริหารจัดการความปลอดภัยของกองทุน พยายามหลีกเลี่ยงการควบคุมความเสี่ยง หรือต้องสงสัยว่าเกี่ยวข้องกับกิจกรรมทางการเงินที่ผิดกฎหมาย</div><h2 style="text-align:left"><strong style="font-weight:bolder">5.8 กิจกรรมฉ้อโกงที่อาจเกี่ยวข้องกับธุรกรรมแบบ P2P</strong></h2><div style="text-align:left">หมายถึงกิจกรรมที่ต้องสงสัยว่าเป็นการฉ้อโกงหรือผิดกฎหมายเกี่ยวกับการเงินที่กระทำโดยผู้ใช้ระหว่างการทำธุรกรรมแบบ P2P (peer-to-peer) ซึ่งรวมถึงแต่ไม่จำกัดเพียง:</div><div style="text-align:left">5.8.1 การใช้บัญชีธนาคาร เครื่องมือการชำระเงิน หรือข้อมูลระบุตัวตนที่ถูกขโมย ปลอมแปลง ไม่ได้รับอนุญาต หรือถูกบุกรุกในลักษณะอื่นใด เพื่อทำการเทรดแบบ P2P</div><div style="text-align:left">5.8.2 การมีส่วนร่วม การช่วยเหลือ หรือการอำนวยความสะดวกในการฉ้อโกงทางโทรคมนาคม การหลอกลวงทางสังคม การรับโอนเงินผิดกฎหมาย การถอนเงินสด หรือการไหลเวียนของเงินทุนที่ผิดกฎหมายอื่นๆ ผ่านธุรกรรม P2P</div><div style="text-align:left">5.8.3 การจัดทำหลักฐานการชำระเงินปลอม การปลอมแปลงบันทึกการโอน หรือการหลอกลวงคู่สัญญาให้ปล่อยทรัพย์สินโดยไม่มีการชำระเงินจริง</div><div style="text-align:left">5.8.4 การกระทำการบีบบังคับ ข่มขู่ หลอกลวง หรือชักจูงให้คู่สัญญาปล่อยทรัพย์สินหรือดำเนินการคืนเงิน หรือการกระทำการเรียกคืนเงิน/ข้อพิพาทการชำระเงินโดยเจตนาร้าย</div><div style="text-align:left">5.8.5 การทำธุรกรรมด้วยเงินทุนที่มีแหล่งที่มาหรือวัตถุประสงค์ผิดปกติหรือไม่สอดคล้องกับวัตถุประสงค์ที่ผู้ใช้แจ้งไว้ โปรไฟล์ความเสี่ยง ความสามารถทางการเงิน หรือรูปแบบการทำธุรกรรม</div><div style="text-align:left">5.8.6 การพยายามหลีกเลี่ยงการควบคุมความเสี่ยงของแพลตฟอร์ม ขัดขวางลำดับการเทรดปกติ หรือมีส่วนร่วมในกิจกรรมที่ต้องสงสัยว่าเป็นการกระทำทางการเงินที่ผิดกฎหมาย</div><h2 style="text-align:left"><strong style="font-weight:bolder">5.9 การรับทราบ</strong></h2><div style="text-align:left">เพื่อป้องกันความเข้าใจผิด กิจกรรมการทำธุรกรรมต้องห้ามนั้นรวมถึง ก<strong style="font-weight:bolder">ารเทรดเพื่อผลประโยชน์ส่วนตนและการเทรดปั่นราคา การปั่นตลาดและการหลอกลวงตลาด การส่งคำสั่งเทรดมากเกินไป และกิจกรรมการทำธุรกรรมที่ผิดปกติอื่นๆ ที่อาจถูกห้ามโดยกฎหมาย ข้อบังคับ และหลักปฏิบัติทางการเงินที่เกี่ยวข้อง</strong></div><div style="text-align:left">MEXC มีอำนาจตัดสินใจแต่เพียงผู้เดียวในการพิจารณาว่าการกระทำใดๆ ถือเป็นกิจกรรมการทำธุรกรรมต้องห้ามหรือไม่ และอาจใช้มาตรการใดๆ ก็ตามที่เห็นว่าเหมาะสม รวมถึงแต่ไม่จำกัดเพียง การระงับ การจำกัด หรือการยกเลิกบัญชี การริบกำไร และการรายงานต่อหน่วยงานกำกับดูแล ตัวอย่างเช่น แต่ไม่จำกัดเพียง:</div><div style="text-align:left">ตัวอย่างที่กล่าวมาข้างต้นนี้มีไว้เพื่อเป็นตัวอย่างประกอบความเข้าใจเท่านั้น ตัวอย่างเหล่านี้ไม่ได้ครอบคลุมทุกกรณี และ MEXC ขอสงวนสิทธิ์ในการตรวจสอบ พิจารณา และดำเนินการใดๆ กับพฤติกรรมที่ MEXC เห็นว่าเป็นการละเมิดแนวทางปฏิบัตินี้ ข้อตกลง หรือกฎหมายและข้อบังคับที่เกี่ยวข้อง ไม่ว่าพฤติกรรมนั้นจะอยู่ในตัวอย่างที่กล่าวมาข้างต้นหรือไม่ก็ตาม</div><h1 style="text-align:left"><strong style="font-weight:bolder">6. ข้อจำกัดในการถอนเงินและข้อจำกัดของบัญชี</strong></h1><div style="text-align:left">MEXC อาจกำหนดข้อจำกัดในการถอนเงินชั่วคราวหรือถาวร และ/หรือ ข้อจำกัดอื่นๆ ในกรณีต่อไปนี้:</div><div style="text-align:left">(ก) ระยะเวลาพักการทำงานเพื่อความปลอดภัยที่บังคับใช้หลังจากการแก้ไขข้อมูลประจำตัวการตรวจสอบสิทธิ์ (เช่น การรีเซ็ตรหัสผ่านหรือ 2FA)</div><div style="text-align:left">(ข) การเปิดใช้งานกลไกควบคุมความเสี่ยงอัตโนมัติ</div><div style="text-align:left">(ค) การนำโปรโตคอลความปลอดภัยที่ได้รับการปรับปรุงมาใช้สำหรับที่อยู่ถอนเงินที่ได้รับอนุญาตใหม่</div><div style="text-align:left">(d) การปฏิบัติตามข้อกำหนดทางกฎหมายหรือคำสั่งของหน่วยงานบังคับใช้กฎหมาย</div><div style="text-align:left">ข้อจำกัดส่วนใหญ่จะมีผลบังคับใช้เป็นเวลายี่สิบสี่ (24) ชั่วโมง อย่างไรก็ตาม MEXC ขอสงวนสิทธิ์ในการลดระยะเวลา ขยายระยะเวลา หรือบังคับใช้ข้อจำกัดดังกล่าวเป็นการถาวร ขึ้นอยู่กับสถานการณ์จริงและการพิจารณาความเสี่ยง</div><h1 style="text-align:left"><strong style="font-weight:bolder">7. ขั้นตอนการทบทวนและแก้ไขปัญหา</strong></h1><h2 style="text-align:left"><strong style="font-weight:bolder">7.1 หน่วยงานกำกับดูแลและอำนาจในการบังคับใช้กฎหมาย</strong></h2><div style="text-align:left">เมื่อตรวจพบการละเมิดที่ต้องสงสัย MEXC มีอำนาจในการใช้มาตรการบังคับใช้โดยไม่ต้องแจ้งให้ผู้ใช้ที่ได้รับผลกระทบทราบล่วงหน้า ซึ่งรวมถึงแต่ไม่จำกัดเพียง:</div><div style="text-align:left">(ก)<strong style="font-weight:bolder"> ข้อกำหนดการรายงานภาคบังคับ</strong>: บังคับให้ผู้ใช้จัดเตรียมเอกสารอย่างครบถ้วนเกี่ยวกับกิจกรรมการเทรดที่ถูกตั้งคำถาม</div><div style="text-align:left">(ข) <strong style="font-weight:bolder">ข้อจำกัดในการเข้าถึง</strong>: การระงับหรือยุติการเข้าถึงบริการแพลตฟอร์มและสิ่งอำนวยความสะดวกในการเทรดของผู้ใช้ (ค) <strong style="font-weight:bolder">ข้อจำกัดในการเทรด</strong>: การบังคับใช้ข้อจำกัดในการวางคำสั่ง การปรับเปลี่ยนสถานะ และขั้นตอนการบังคับชำระบัญชี</div><div style="text-align:left">(ง) <strong style="font-weight:bolder">ข้อจำกัดทางการเงิน</strong>: การกำหนดข้อจำกัดในการถอนและฝากเงินระหว่างรอผลการสอบสวนเสร็จสิ้น (จ) การปิดบัญชีและการยึดทรัพย์สิน: การยกเลิกบัญชีผู้ใช้พร้อมยึดทรัพย์สินที่เหลืออยู่ หากกฎหมายอนุญาต</div><div style="text-align:left">(ฉ)<strong style="font-weight:bolder"> มาตรการแก้ไขเพิ่มเติม</strong>: มาตรการบังคับใช้กฎหมายอื่นใดที่เห็นว่าจำเป็นภายใต้กฎธุรกิจและข้อกำหนดด้านกฎระเบียบที่เกี่ยวข้อง</div><h2 style="text-align:left"><strong style="font-weight:bolder">7.2 การทบทวน การตรวจสอบ และการประเมินผล</strong></h2><div style="text-align:left">เมื่อตรวจพบกิจกรรมที่อาจน่าสงสัยหรือกลไกควบคุมความเสี่ยงถูกกระตุ้น MEXC อาจทำการประเมินเบื้องต้นเพื่อพิจารณาว่าพฤติกรรมของผู้ใช้เป็นการละเมิดกฎหมาย ข้อบังคับ ข้อตกลง แนวทางปฏิบัตินี้ หรือนโยบายอื่นๆ ที่เกี่ยวข้องหรือไม่</div><div style="text-align:left">หลังจากการประเมินเบื้องต้น MEXC อาจพิจารณาตัดสินโดยอ้างอิงถึง: (ก) ลักษณะและความร้ายแรงของการละเมิดใดๆ (ข) การละเมิดนั้นกระทำโดยลำพังหรือเป็นส่วนหนึ่งของแผนการที่ประสานงานกัน (ค) มาตรการบังคับใช้ที่เหมาะสมซึ่งได้สัดส่วนกับความร้ายแรงของการละเมิด</div><div style="text-align:left">เพื่อความชัดเจน แต่ละกรณีจะได้รับการพิจารณาตามข้อเท็จจริงและสถานการณ์เฉพาะของแต่ละกรณี และ MEXC ขอสงวนสิทธิ์ในการใช้วิธีการสืบสวน ประเมิน และบังคับใช้ที่แตกต่างกันไปตามที่เห็นสมควรโดยดุลพินิจของตนแต่เพียงผู้เดียว</div><h2 style="text-align:left"><strong style="font-weight:bolder">7.3 มาตรการแก้ไขและบทลงโทษ</strong></h2><div style="text-align:left">MEXC อาจดำเนินการมาตรการแก้ไขที่ครอบคลุมหลังจากตรวจสอบอย่างละเอียดถี่ถ้วน ซึ่งรวมถึง: (ก) การจำกัดบัญชีเป็นระยะเวลาต่างๆ กัน สูงสุด 180
