правил, інструкцій, обмежень або для проведення неналежного арбітражу.</div><div> <strong style="font-weight:bolder">5.6.2</strong> Скоординована торгова поведінка між кількома акаунтами з метою здійснення непропорційного впливу на ринок або маніпулювання ринковою ціною, глибиною або ліквідністю.</div><div> <strong style="font-weight:bolder">5.6.3</strong> Хеджування або міжринковий арбітраж, використання розбіжностей у правилах або лазівок у системі для проведення безризикового арбітражу, який включає незаконні кошти або призводить до маніпулювання ринком, що порушує нормальне торгове </strong>Участь в аномальних моделях руху коштів, зокрема швидкий притік/відтік коштів, транзакції на велику вартість або високочастотні транзакції без законної економічної мети, невідповідні або незвичайні контрагенти транзакцій або непрозорі потоки коштів;</div><div> <strong style="font-weight:bolder">5.7.5</strong> Будь-яка інша поведінка, яка порушує управління безпекою коштів, намагається обійти засоби контролю ризиків або підозрюється у зв&#39;язку з незаконною фінансовою діяльністю.</div></div></div></div></div><div><div><h2><strong style="font-weight:bolder">5.8 Шахрайська Обмеження на зняття коштів та обмеження акаунту</strong></h1><div>MEXC може накласти тимчасові або постійні обмеження на зняття коштів та/або обмеження за таких обставин: (а) обов&#39;язкові періоди «охолодження» безпеки після зміни облікових даних для аутентифікації (таких як пароль або скидання 2FA); (б) активація автоматизованих механізмів контролю ризиків; (в) впровадження посилених протоколів безпеки для нових авторизованих адрес для зняття коштів; (г) дотримання регуляторних вимог або директив правоохоронних органів.</div><div>Більшість обмежень залишаються в силі протягом двадцяти чотирьох (24) годин; однак MEXC залишає за собою право, скорочувати, продовжувати або накладати такі обмеження на постійній основі, залежно від фактичних обставин та ризиків.</div><h1 style="text-align:left"><strong style="font-weight:bolder">7. Процедура розгляду та вирішення</strong></h1><h2><strong style="font-weight:bolder">7.1 </strong>Регуляторний орган та повноваження щодо забезпечення виконання</h2><div>У разі виявлення підозри на порушення, MEXC має право без попереднього повідомлення задіяних користувачів застосовувати свої повноваження щодо забезпечення виконання, зокрема:</div><div>(а) <strong style="font-weight:bolder">Обов&#39;язкові вимоги щодо звітності:</strong> зобов&#39;язувати користувачів надати вичерпну документацію щодо сумнівних торгових операцій; (б) <strong style="font-weight:bolder">Обмеження доступу:</strong> призупиняти або припиняти доступ користувачів до послуг Платформи та торгових функцій; (в) <strong style="font-weight:bolder">Обмеження торгівлі:</strong> впроваджувати обмеження на розміщення ордерів, зміну позицій і процедури примусової ліквідації; (г) <strong style="font-weight:bolder">Фінансові обмеження:</strong> накладати обмеження на зняття і депозит до завершення розслідування; (ґ) <strong style="font-weight:bolder">Закриття акаунту та конфіскація активів:</strong> припиняти дії акаунтів користувачів з конфіскацією залишкових активів, якщо це дозволено законом; (д) <strong style="font-weight:bolder">Додаткові виправні заходи:</strong> інші заходи примусового виконання, які вважаються необхідними відповідно до чинних правил ведення діяльності та регуляторних вимог.</div><h2><strong style="font-weight:bolder">7.2 </strong>Розгляд, розслідування та оцінка</h2><div>Після виявлення потенційно підозрілої діяльності або активації механізму контролю ризиків, MEXC може провести попередню оцінку, щоб визначити, чи становить поведінка Користувача порушення чинних законів, нормативних актів, Угоди, цих Керівних принципів або інших політик.</div><div>Після попередньої оцінки MEXC може прийняти рішення, з огляду на: (а) природу та серйозність порушень; (б) чи порушення були здійснені індивідуально або в межах скоординованих схем; (в) відповідні заходи щодо забезпечення дотримання, пропорційні серйозності порушення.</div><div>Для уникнення сумнівів, кожен випадок розглядається з огляду на його власні факти й обставини, і MEXC залишає за собою право застосовувати різні методи розслідування, оцінки та забезпечення дотримання, які вважає за доцільні на власний розсуд.</div><h2><strong style="font-weight:bolder">7.3 </strong>Виправні заходи та санкції</h2><div>MEXC може вжити комплексних виправних заходів після ретельного розслідування, зокрема: (а) обмеження акаунту на термін до 180 днів (або довше, якщо це передбачено іншою політикою); (б) скасування транзакцій і конфіскація прибутку; (в) заморожування активів до узгодження з регуляторними органами; (г) постійне виключення з послуг Платформи у випадках серйозних порушень. Виправні заходи можуть відрізнятися залежно від конкретного випадку відповідно до розслідуваних фактів, а зловживання на груповому рівні може спричинити більш тривалі обмеження.</div><h3><strong style="font-weight:bolder">7.3.1 Період посиленого моніторингу (30-денне спостереження)</strong></h3><div>Акаунти, що демонструють підозрілі моделі торгівлі, підлягають посиленому моніторингу протягом тридцяти (30) днів. Цей період дозволяє провести комплексну оцінку поведінки користувача та зменшити кількість помилкових рішень. MEXC залишає за собою право продовжити цей період залежно від обставин.</div><div>Протягом цього періоду моніторингу MEXC може проводити такі заходи для подальшого розслідування справи:</div><ul style="list-style-type:disc" start="1"><li style="text-align:left"><div>Відстеження спроб користувачів торгувати через нові акаунти або раніше зареєстровані акаунти протягом періоду спостереження, особливо тих, що мають збіжні IP-адреси або подібні моделі торгівлі.</div></li><li style="text-align:left"><div>Виявлення скоординованої торгової поведінки між декількома пов&#39;язаними акаунтами, яка може вплинути на ринкові ціни, незалежно від того, чи відбувалася вона в минулому, чи протягом поточного періоду спостереження.</div></li></ul><h3><strong style="font-weight:bolder">7.3.2 Подовжений період обмеження (180-денне обмеження)</strong></h3><div>Акаунти, які беруть участь у скоординованих порушеннях, діяльності з високим рівнем ризику або викликають значні занепокоєння щодо дотримання вимог, можуть бути обмежені на термін до ста вісімдесяти (180) днів (або довше, якщо це передбачено іншою політикою). Цей захід виконує як стримувальну, так і захисну функцію, надаючи достатньо часу для координації регуляторних заходів.</div><h3><strong style="font-weight:bolder">7.3.3 Повернення</strong></h3><div>З метою збереження цілісності ринку та захисту правомірних користувачів, MEXC також залишає за собою право скасувати транзакції, які (а) порушують чинне законодавство, нормативні акти, Угоду, ці Керівні принципи та/або інші Юридичні документи або політику MEXC; і (б) впливають на торговельні операції інших користувачів та нормальні торговельні процедури. Рішення про повернення коштів приймаються після ретельного аналізу даних про транзакції та торгові моделі. Однак можливі випадки, коли добросовісних користувачів може бути тимчасово обмежено або позначено. Якщо акаунт було обмежено чи позначено з наведених вище причин, користувач може звернутися до служби підтримки MEXC, щоб отримати найновішу інформацію щодо стану акаунту.</h3><h3>7.4.5 З міркувань безпеки деталі внутрішніх механізмів контролю ризиків або процедур перевірки MEXC не підлягають розголошенню, а тривалість або результат будь-якої перевірки не можуть бути гарантовані.</h3><h1 style="text-align:left"><strong style="font-weight:bolder">8. Маніпулювання з використанням декількох акаунтів: приклад з практики</strong></h1><div><strong style="font-weight:bolder">Підозріла активність з пов&#39;язаних акаунтів</strong></div><div>Кілька акаунтів демонстрували явні ознаки узгодженості дій та брали участь у торгових операціях, що порушують правила платформи.
